Introduction: MM, born on [DOB REDACTED], is a vulnerable adult by virtue of living at the Lyngblomsten Care Center, a long- term care facility, located in St. Paul, Ramsey County. On August 2, 2022, MM’s daughter, Natalie Farnshawn Mills-Walker, Defendant herein, signed an admission contract with the Lyngblomsten Care Center, agreeing to be MM’s “responsible party.” Defendant signed the admission contract on behalf of MM, who did not sign. A staff person from Lyngblomsten Care Center also signed the contract.
The agreement indicates that it went into effect on July 27, 2022. The contract had a section regarding what the “responsible party” agreed to do. The responsible party, had to agree, inter alia, that they had “access to Resident’s income, assets, and resources and agrees to apply Resident’s income, assets and resources to pay for care provided to Resident and other amounts due under this Agreement in accordance with this Agreement unless and until such costs are paid by private insurance or other benefits such as Medicare, Veteran’s Health Insurance or Medical Assistance.” Financial Exploitation: On December, 24, 2024, Cha Xiong, from Ramsey County Adult Protective Services contacted the Saint Paul Police Department to report fraud, with an excess of $25,000 in seemingly exploited funds.
Additionally, the Defendant failed to pay Lyngblomsten for the cost of MM’s care, in violation of the admission contract that Defendant signed. In September, 2023, Cha Xiong received a report from a mandatory reporter at Lyngblomsten Care Center stating Defendant had failed to assist MM in managing MM’s finances. Defendant had failed to pay the spenddown to the long-term care facility and MM owed the facility $11,410.00 on September 1, 2023. Additionally, MM’s social security benefit was also suspended.
The social security representative indicated they had not received the “Continuing Disability Review Report” from Defendant. Staff at the care facility attempted to reach the Defendant to offer assistance, but Defendant never responded. Cha Xiong went through MM’s bank records from January 2019 and July 2024, and noted numerous questionable purchases that are not consistent with someone living in a care facility, which totaled over $25,000. In Adult Protection’s Vulnerable Adult Maltreatment Report, the writer noted “[Vulnerable Adult] is unable to pay for her needed care.” MM was receiving Social Security Deposits monthly of a little over $1,000. These Social Security payments seem to end on February 28, 2023. MM’s account then goes negative $102.33 on March 31, 2023. Suspicious transactions not characteristic of a person in long-term care were occurring all throughout 2022 and early 2023 leading up to the account going negative.
