On November 23, 2025, at approximately 6:57 A.M., Fridley Police Officers were dispatched to the area of 53rd Avenue N. E. And University Avenue East Service Drive N. E., in the City of Fridley, Anoka County, Minnesota, on a report of a driver slumped over in a vehicle. On arrival, officers located a Hyundai Elantra bearing MN license plate [PLATE REDACTED] at the intersection. The vehicle was not moving, was on the curb and the windshield wipers were on. There was a male in the driver's seat, later identified as Carlos Daniel Agualongo Tualombo, [DOB REDACTED], the defendant herein.
Allina paramedics were on scene and confirmed that defendant was breathing. The vehicle was in neutral, so officers boxed it in. Officers observed that the keys were in the ignition of the vehicle. Officers attempts to wake up defendant were unsuccessful until they used sternum rubs and forcing defendant's eyes to open. Officers smelled the odor of a consumed alcoholic beverage emitting from the vehicle. Officers observed multiple empty beer cans in the vehicle. Defendant woke up and was very incoherent.
Defendant had bloodshot and watery eyes. When defendant exited the vehicle, he almost fell over. Officers could smell the odor of a consumed alcoholic beverage emitting from defendant. Officers held up defendant so he would not fall over. While holding defendant, he pulled down his pants and began urinating on the road. Officers had to escort defendant to a stretcher because he could not walk on his own. While escorting defendant, he spit in the direction of Officer Stephens face. Officer Stephens shifted away while continuing to hold onto defendant, and felt a small amount of saliva mist hit the left side of her face.
Officers were unable to conduct field sobriety tests due to defendant's behavior. Officers located a wallet on defendant, and were able to confirm his identity. Officers found that defendant's driver's license was revoked. During an inventory search of the vehicle, officers located ten empty 12oz Modelo beer cans on the front passenger floorboard and inside the door frame. Officers obtained a search warrant to take a blood sample from defendant. Officers went into defendant's hospital room and observed that he was asleep, was in restraints and had a spit hood on.
Nurses advised that they had to give defendant medication because defendant woke up and began fighting with hospital staff. Defendant was spitting and attempting to swing at and bite staff. Officers were unable to wake up defendant due to the medication administered by hospital staff. A blood sample was taken at 8:19 A.M. And results are currently pending. Complainant has reviewed documents pertaining to defendant's Minnesota driving record which reveal that defendant's Minnesota driving privilege was revoked for alcohol‐related incident(s), and/or defendant was convicted of impaired driving offense(s) from incident dates as noted in the following table.
