On September 6, 2025, at approximately 10:17 A.M., Austin Police Department Officer Nathan Hoefs was dispatched to a residence in the 900 block of 13" Avenue NW in the City of Austin, Mower County to speak with Victim A (an adult male) regarding a vandalism incident he reported the prior evening (see ICR 202510013652). Victim A stated he had additional evidence for law enforcement. Officer Hoefs met Victim A outside of the residence. Victim A stated he lives in the home with his grandmother, his cousin (Witness 1, an adult male), and his uncle, THAVINH KULLAVONGSA, [DOB REDACTED], hereinafter the defendant.
Victim A stated he and his friend, Witness 2 (an adult male), and Witness 1 had been drinking the night before. Victim A stated he was lying in his bed in his bedroom this morning, and Witness 2 was also in the room. The defendant began pounding on his bedroom door, screaming about wanting his money and a PlayStation controller. Victim A stated he did not borrow or take anything from the defendant. Victim A stated the defendant uses methamphetamine and spends most of his time in the basement, however Victim A has had similar confrontations with the defendant in the past.
During those confrontations, the defendant has brandished a gun, so Victim A decided to get his own gun before opening the bedroom door. Victim A asked Witness 2 to record whatever occurred using his cell phone. Victim A opened the bedroom door, holding his handgun in his right hand but down by his side. Once he opened the door, he saw the defendant was holding a black, semi-automatic handgun in his right hand, and it was up and pointed at Victim A's chest. Victim A said he raised his gun up to his side but not directly pointing at the defendant.
The defendant immediately noticed the gun and tried to grab it with his left hand. Victim A then grabbed the defendant's gun with his left hand, and the two struggled, falling to the ground, Victim A said he tried to keep a hand on the defendant's gun to keep it pointed toward the ground. Witness 3 then began to hit the defendant in the head, and somehow, the magazine fell out of the defendant's gun. Victim A saw that there were bullets in the magazine, so he kicked it away. The defendant broke free, picked up the magazine, and went downstairs.
Victim A, Witness 1, and Witness 2 left the residence to contact law enforcement. Austin Police Department Officer Michael Hullopeter also arrived on scene and spoke with Witness 1. Witness I stated he lives at the house with Victim A, Victim A's grandmother, and Victim A's uncle, the defendant. Witness 1 stated he was sleeping this morning and woke up to the defendant yelling and banging on Victim A's bedroom door. Witness 1 stated the defendant was yelling about money Victim A supposedly owes the defendant and a PlayStation controller.
