On August 27, 2025 at approximately 10:15 A.M., Austin Police Department Officer Sam Schuweiler was dispatched to the Mower County Law Enforcement Center (LEC) parking lot to assist TIMOTHY SORGINE, [DOB REDACTED], hereinafter the defendant, with the Narcan vending machine. As Officer Schuweiler was responding, he was advised by dispatch that the defendant was now kicking the machine. Upon arrival, Officer Schuweiler spoke with the defendant. The defendant advised that he needed assistance getting the Narcan out of the vending machine.
The defendant stated the boxes were too large for the machine and were getting stuck. Officer Schuweiler assisted the defendant by obtaining a box from the vending machine and giving it to him. Officer Schuweiler then observed that the defendant already had several boxes of Narcan in a bag. Officer Schuweiler spoke with the defendant as the defendant continued to try to remove additional Narcan boxes from the machine, and the defendant again asked for his help in retrieving more boxes. Officer Schuweiler asked the defendant why he needed more as it appeared he had several, and the defendant stated the vending machine's internal temperature was too hot and the Narcan was no longer good.
Officer Schuweiler noted that the vending machine is climate controlled, The defendant then told Officer Schuweiler that he would kick the vending machine's door to open it if Officer Schuweiler did not assist him. Officer Schuweiler told the defendant he had already helped him obtain several boxes of Narcan, and it would be too time consuming to assist him in emptying the entire vending machine if that was his intention. Officer Schuweiler also told the defendant he should not kick the vending machine as doing so could cause damage, and the defendant would be responsible for any damage.
The defendant began kicking the vending machine repeatedly in an effort to open the door, and Officer Schuweiler observed a piece of black plastic eject from the door that appeared to have broken off from inside the machine. Officer Schuweiler heard the defendant say something like he was happy he broke the vending machine and also said he would retrieve a hammer and break the glass in order to empty it. Officer Schuweiler again told the defendant not to damage the vending machine. The defendant eventually emptied the contents of the vending machine, picked up the plastic piece that he had broken off, and left.
On September 17, 2025, Austin Police Department Chief David McKichan spoke to the defendant by telephone, The defendant said he wished to discuss the incident involving the Narcan vending machine, stating he wanted to contest any allegations that he damaged it but also wanted to discuss the existence of the vending machine generally. On September 22, 2025, Chief McKichan was informed the defendant was in the lobby of the law enforcement center, requesting a copy of the original police report. Chief McKichan advised the report could not be released yet as the matter was still under investigation.
